Bu şartlar; EliteBy dispeçer paneli, EliteBy Transfer şoför uygulaması ve müşterilere gönderilen takip sayfası (birlikte "Hizmet") için geçerlidir. Hizmeti CORETECH İNOVASYON TEKNOLOJİ LİMİTED ŞİRKETİ("EliteBy", "biz") sunar. Hizmeti kullanarak bu şartları kabul etmiş olursunuz.
1. Hizmetin tanımı
EliteBy, transfer ve taşımacılık firmalarının işleri şoförlerine dağıtmasını, araçlarını canlı takip etmesini ve müşterilerine takip bağlantısı göndermesini sağlayan bir yazılımdır. EliteBy taşımacılık hizmeti vermez; yolculuğu firma ve şoför gerçekleştirir. Firma ile müşterisi arasındaki ücret, ödeme, iptal ve sorumluluk konuları EliteBy'ın tarafı olmadığı, firma ile müşteri arasındaki ilişkidir.
2. Firma hesabı ve abonelik
- Firma hesabını açan kişi, firmayı temsil etmeye yetkili olduğunu kabul eder.
- Yeni firmalar 14 gün ücretsiz deneme kullanabilir. Deneme sonunda kullanım, panelde belirtilen paket ücretine tabidir.
- Paketler aynı anda kullanılabilecek aktif şoför sayısıyla sınırlıdır (Başlangıç 5, İşletme 15, Profesyonel 30). Fiyatlar KDV hariçtir; ödemede %20 KDV eklenir.
- Abonelik seçilen süre (1 ya da 12 ay) için kartla peşin ödenir ve otomatik yenilenmez; süre bitmeden yeniden ödenerek uzatılır, kalan süre korunur.
- Ödenen dönem için ücret iadesi yapılmaz; yürürlükteki mevzuattan doğan haklar saklıdır.
- Süre biterse şoförler yeni iş kabul edemez; veriler bir süre saklanır ve firma talep ederse silinir.
- Firma, panele girdiği şoför ve müşteri bilgileri için gerekli bilgilendirmeleri yapmak ve izinleri almakla yükümlüdür.
3. Şoför uygulaması
- Uygulamaya yalnızca firmanın panelden eklediği şoförler, firmanın verdiği giriş koduyla girebilir. Uygulama içinde ücretli bir işlem yoktur.
- Giriş kodu kişiseldir; başkasıyla paylaşılmamalıdır. Kod kaybolursa firma panelden yeni kod üretir.
- Konum yalnızca şoför "Mesaiye başla" dediğinde paylaşılır ve "Mesaiyi bitir" denince durur.
- Şoför, trafik kurallarına uymaktan ve araç kullanırken telefonu güvenli biçimde kullanmaktan kendisi sorumludur.
4. Yasak kullanımlar
Hizmet; yasa dışı amaçlarla, başkalarının izni olmadan takip edilmesi için, sisteme yetkisiz erişim denemesiyle veya hizmetin işleyişini bozacak şekilde kullanılamaz. Bu durumlarda hesabı askıya alma hakkımız saklıdır.
5. Sorumluluğun sınırı
Hizmeti kesintisiz ve hatasız sunmak için makul özeni gösteririz; ancak internet, cihaz, GPS ve bildirim servislerinden kaynaklanan gecikme ve kesintilerden sorumlu değiliz. Yürürlükteki mevzuatın izin verdiği ölçüde, dolaylı zararlardan ve kâr kaybından sorumluluğumuz yoktur.
6. Gizlilik
Kişisel verilerin nasıl işlendiği Gizlilik Politikası'nda açıklanmıştır.
7. Değişiklikler, hukuk ve iletişim
Bu şartları güncelleyebiliriz; güncel metin bu sayfada yayınlanır. Bu şartlara Türkiye Cumhuriyeti hukuku uygulanır; uyuşmazlıklarda İstanbul mahkemeleri ve icra daireleri yetkilidir. Tüketici sıfatıyla kullanan kişilerin yasal hakları saklıdır.

1. The service
These terms apply to the EliteBy dispatch panel, the EliteBy Transfer driver app and the passenger tracking page (the "Service"), provided by CORETECH İNOVASYON TEKNOLOJİ LİMİTED ŞİRKETİ("EliteBy"). EliteBy is software that lets transfer companies assign jobs to their drivers, track vehicles live and send passengers a tracking link. EliteBy does not provide transport; the trip is carried out by the company and its driver. Fares, payment, cancellation and liability between a company and its passengers are a matter between them, and EliteBy is not a party to it.
2. Company accounts and subscription
- The person who opens a company account confirms they are authorised to act for the company.
- New companies may use a 14-day free trial. After the trial, use is subject to the plan fee shown in the panel.
- Plans are limited by the number of active drivers (Starter 5, Business 15, Professional 30). Prices exclude VAT; 20% VAT is added at payment.
- The subscription is prepaid by card for the chosen term (1 or 12 months) and does not renew automatically; paying again before it ends extends it and keeps the remaining time.
- Fees for a paid term are not refunded, without prejudice to statutory rights.
- When the term ends, drivers cannot accept new jobs; data is kept for a period and deleted on request.
- The company is responsible for informing, and obtaining any consent from, the drivers and passengers whose data it enters.
3. Driver app
- Only drivers added by their company can sign in, with the login code the company gives them. There are no in-app purchases.
- The login code is personal and must not be shared. If it is lost, the company issues a new one in the panel.
- Location is shared only after the driver taps "Go on duty" and stops when they go off duty.
- Drivers are responsible for obeying traffic rules and using their phone safely while driving.
4. Prohibited use
The Service may not be used for unlawful purposes, to track anyone without their consent, to attempt unauthorised access, or in a way that disrupts the Service. We may suspend accounts that do so.
5. Limitation of liability
We take reasonable care to keep the Service available and accurate, but we are not responsible for delays or outages caused by the internet, devices, GPS or notification services. To the extent permitted by law, we are not liable for indirect damages or lost profits.
6. Privacy, changes, law and contact
How personal data is processed is described in our Privacy Policy. We may update these terms; the current version is published on this page. These terms are governed by the laws of the Republic of Türkiye and the courts of Istanbul have jurisdiction, without prejudice to the statutory rights of consumers.
